1. Introduction

Welcome to BNO Sports (the "App"), operated by Dmytro Kotelin. These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Dmytro Kotelin regarding your access to and use of the App on iOS devices, as well as any related websites, platforms, services, features, content, and communications (collectively, the "Services"). By downloading, installing, registering, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2.1 Eligibility Requirements:

You are solely responsible for all activities conducted through your account and for ensuring that anyone who accesses the App through your account complies with these Terms.

3. License and Intellectual Property Rights

3.1 Limited License:

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on an iOS device that you own or control, solely for your personal, non-commercial purposes.

3.2 Intellectual Property Ownership:

All content, features, graphics, user interfaces, trademarks, trade names, logos, designs, text, images, audio, video, software, code, and other materials (collectively, "Content") are owned, controlled, or licensed by or to Dmytro Kotelin. Except for the limited license granted herein, you have no other rights in or to the App or the Content. All intellectual property rights not expressly granted are reserved.

3.3 Restrictions:

You agree not to:

• Copy, reproduce, modify, distribute, publicly display, publicly perform, adapt, translate, or create derivative works from the App or Content without our prior written consent.
• Decompile, reverse engineer, disassemble, or attempt to derive source code from the App or any Content.
• Remove, obscure, or alter any copyright, trademark, or proprietary notices.
• Use any automated system or scraping tool to access the App for any unauthorized purpose.

4. App Features and Services

The App may include a broad range of features and functionalities, such as:

• Registration and Login: Account creation and profile management.
• Gameplay and Virtual Worlds: Access to games, quests, leaderboards, tournaments, and virtual goods.
• Social Features: Chat functions, friend lists, community forums, and user-generated content posting.
• Media and Content Streaming: Viewing or listening to videos, music, podcasts, or live streams.
• E-commerce: Browsing and purchasing products, subscriptions, or digital goods.
• User-Generated Content (UGC): Uploading or sharing photos, videos, audio clips, and text.
• Augmented Reality (AR)/Virtual Reality (VR): Immersive experiences and device sensor integrations.

5. User Conduct

5.1 Prohibited Activities:

You agree not to use the App in any manner that:

• Violates any applicable laws or these Terms.
• Infringes on the rights of others, including intellectual property or privacy rights.
• Is fraudulent, deceptive, harassing, obscene, hate-oriented, defamatory, or threatening.
• Encourages self-harm or unlawful activities.
• Attempts to gain unauthorized access to the App or its data.
• Transmits viruses, malware, or harmful code.
• Interferes with the operation or security of the App or other networks.

5.2 User-Generated Content (UGC):

Content Standards: Any UGC you post must comply with these Terms and applicable laws. You must not post content that is harassing, violent, or discriminatory.

Licensing of UGC: By submitting UGC, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use and display your content in connection with the App.

Monitoring and Enforcement: We reserve the right to remove or disable UGC that violates these Terms or is harmful.

6. Virtual Goods and In-App Purchases

6.1 Virtual Goods:

The App may offer virtual goods (e.g., virtual currency, upgrades, digital collectibles) that have no real-world monetary value and may expire upon account termination.

6.2 In-App Purchases:

If you make an in-app purchase (such as subscriptions or premium content), you agree to the pricing and billing terms displayed at the time of purchase. Payments are processed by third-party platforms (e.g., Apple App Store).

6.3 No Refunds:

Except as required by law or platform policies, all in-app purchases are final and non-refundable.

7. Third-Party Links and Services

The App may include links to third-party websites or services. We are not responsible for their content or availability.

8. Privacy and Data Protection

Your use of the App is subject to our Privacy Policy.

9. Security and Data Transmission

10. Disclaimer of Warranties

To the fullest extent permitted by law, Dmytro Kotelin and its affiliates shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the App.

You agree to indemnify and hold Dmytro Kotelin harmless from any claims arising from your use of the App or violation of these Terms.

13. Term and Termination

These Terms remain in effect while you use the App. We may terminate or suspend your access for violations of these Terms. Upon termination, your license to use the App ceases.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ukraine. Any disputes shall be exclusively brought in the courts of Ukraine.

15. Export Controls

You agree to comply with all applicable export and import laws. You represent that you are not located in a restricted country.

16. Electronic Communications

By using the App, you consent to receive electronic communications from us regarding these Terms, your account, and the App’s functionalities.

17. Miscellaneous

Severability: If any provision is unenforceable, the remaining provisions remain effective.
No Waiver: Failure to enforce any provision is not a waiver of that right.
Assignment: We may assign these Terms without restriction.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dmytro Kotelin.
